Important Notice Regarding the Receiver's Claims Determinations
On January 22, 2026, the Receiver emailed his Final Determination of your allowed claim amount in the Reconciled Claims Report, which sets forth your claim number, filed claim amount, allowed claim amount, and reconciliation code.

You may appeal the Final Determination of your claim by sending an email to
claimappeal@dvcattorneys.com, specifying
(1) your intent to appeal the Receiver’s Final Determination,
(2) the basis for your appeal, and
(3) if necessary, additional documentation supporting your claim that has not already been submitted.
Your appeal email must be sent by February 11, 2026, at 11:59 p.m. EST.
If your Reconciliation Code states that your claim is “under review,” the Receiver is still determining your allowed claim amount, and you will receive an extended deadline to appeal the Final Determination.

The Court has received a number of letters and comments from investors and other interested parties regarding these proceedings and the Receiver's actions. Several of the letters have requested anonymity for the filer or for the letter to be restricted from public access. Persons seeking to file documents with the Court are CAUTIONED that all Court documents are public by default. Any party seeking leave to file a document non-publicly must seek permission PRIOR to submitting the document. Any document filed without this prior permission may be docketed publicly by the Clerk. A motion to seal or restrict a document must explain why the filing should not be subject to the default rule that all court documents are public. If a party seeking anonymity or confidentiality has already filed a document without obtaining Court permission, they must file a motion to seal or restrict the document that (1) identifies the document already filed with specificity and (2) explains why they are entitled to the relief they seek. Important Investor Notice About False Information
Please be careful with a website and communications that share false or misleading information about the Drive Planning case. The Receiver is aware of an anonymous website providing false information and incorrect legal analysis to investors. This site seeks to convince investors to object to the Receiver’s lawsuits against those who profited from the Drive Planning scheme.
The Court has already given the Receiver permission to sue any investors or agents who made a profit (a net gain) from Drive Planning. These lawsuits aim to help increase the recovery from the receivership for individuals who lost money through Drive Planning. The Receiver’s detailed reports filed with the Court reflect that total investor losses far exceed the value of assets recovered by the Receiver to date, and the Receiver’s ongoing recovery actions are essential to maximize restitution to those who lost money. Opposing these lawsuits is not in the best interests of those who lost money.

NOTICE TO INVESTORS OF DRIVE PLANNING, LLC
The Receiver has proposed certain procedures governing the settlement
of certain claims brought by the Receiver. Investors may submit written
comments or objections regarding the proposed Settlement Procedures directly
to the Receiver at
driveplanningreceiver@dvcattorneys.com by September 20,
2025. All submissions must identify the investor’s name and contact
information. After the 21-day comment period has ended, the Receiver will file
a notice with the Court summarizing any timely comments or objections
received that are responsive to the subject matter of these proposed Settlement
Procedures.

On August 13, 2024, the Securities Exchange Commission (the "SEC") commenced an enforcement action against Drive Planning, LLC (“Drive Planning”) and their principal Russell Todd Burkhalter. That enforcement action is pending in the District Court for the Northern District of Georgia (Atlanta Division) before the Honorable Victoria Calvert.
The Court then appointed Kenneth D. Murena, Esq. to serve as the Receiver over Drive Planning creating a Receivership Estate. As Receiver, Mr. Murena is charged with complete control and possession over Drive Planning's operations, with marshaling the assets of Drive Planning, and with recovering certain assets from Defendant Burkhalter and the named Relief Defendants for the benefit of the investors. The Order Appointing Receiver and other relevant court filings are available for review under the Court Documents tab.
In accordance with the Order Appointing Receiver, the Receiver will use his best efforts to locate and preserve Drive Planning's funds and assets, determine the value of Drive Planning's investments, recover assets held by Defendant Burkhalter and Relief Defendants, identify and communicate with investors to determine the amount of their losses, pursue Drive Planning's claims against third parties holding its assets, and maximize the value of the Receivership Estate for the benefit of investors.
